References to "Pocketloop", "we", "us" or "our" mean Pocketloop Ltd.

These Terms apply to the U.S. market version of Pocketloop, including Pocketloop's sender-enabled gift flexibility features and Pocketloop Points.

2. Eligibility

You must:

• Be at least 18 years old.
• Have legal capacity to enter into a binding contract.
• Use the service for lawful purposes only.

We may refuse service, cancel transactions, or suspend access where fraud, misuse, or unlawful activity is suspected.

3. What You Are Purchasing

When you purchase through Pocketloop:

• You are purchasing the right to send a specified third-party gift through Pocketloop.
• Depending on the product configuration, the recipient may be able to keep the selected brand, swap to another available brand, or split the value across multiple brands before making their final choice.
• The underlying retailer gift card or codes are issued only once the recipient makes their final choice and reveals the code through the platform.
• Until that point, no underlying retailer gift card is issued.

Available features, eligible brands, denominations, and any applicable restrictions are displayed on the relevant product page at the time of purchase.

Once a retailer gift card is issued, it is subject to that retailer's own terms and conditions.

Pocketloop is not affiliated with, endorsed by, or sponsored by any listed retailer unless explicitly stated.

4. Final Choice, Swaps, and Splitting

Pocketloop's sender-enabled flexibility features apply only before the recipient makes their final choice and reveals the gift card code.

• Swaps are available only if the sender enabled swaps for that gift.
• Splitting is available only if the sender enabled splitting for that gift.
• If splitting is offered, the recipient must complete the split during that redemption session using the options presented by Pocketloop at that time.
• Pocketloop does not provide a stored wallet balance, reusable account credit, or cash-out feature for remaining gift value.

If the recipient confirms a split selection without allocating the full available amount, any unallocated remainder is forfeited and cannot later be recovered, reused, converted to cash, or converted to account credit.

After the recipient reveals the code and the retailer gift card or codes are issued, the gift is treated as used in Pocketloop and is no longer eligible for unexercised pre-issuance features.

5. Gift Issuance and Redemption

The recipient's final choice is made when they reveal the gift card code through the platform.

Once the retailer gift card or codes are issued, the retailer's standard terms, eligibility requirements, and usage restrictions apply. Pocketloop is not responsible for retailer policy changes, issuance limitations, or redemption restrictions imposed by the retailer.

Retailers may amend their terms from time to time. The applicable retailer terms are those in effect at the time the gift card is issued.

Pocketloop controls the pre-issuance gift selection experience. Once a retailer gift card or code is issued, that retailer's own terms, restrictions, balance rules, and redemption policies apply.

6. Pocketloop Points

Pocketloop Points are promotional rewards offered by Pocketloop in connection with eligible activity, such as sending a gift, referring a friend, or completing other qualifying actions described on the platform.

• Points are separate from gift value.
• Points are not cash and cannot be exchanged for cash.
• Points are not transferable between users.
• Points may expire or be removed according to the rules shown on the platform.
• Refunded, canceled, fraudulent, or otherwise ineligible orders do not qualify for points, and any related points may be removed.

Points may be redeemed only in the reward tiers and formats made available by Pocketloop at the time of redemption. Pocketloop may modify or discontinue the Points program, or any part of it, at any time to the extent permitted by law.

7. No Cancellation After Purchase

All purchases are final and non-cancelable once completed.

Refunds are not available after purchase except where required by law or where Pocketloop determines, in its sole discretion, that a refund is appropriate because of fraud, duplicate payment, or a clear processing error.

If a retailer gift card or code has already been issued or revealed, refunds are generally unavailable.

8. Delivery and Scheduling

If the sender chooses email delivery, Pocketloop will attempt delivery using the recipient information provided at checkout.

Scheduled deliveries depend on the sender providing accurate recipient details and on normal operation of third-party email systems and infrastructure.

Delivery may be delayed, filtered, or blocked by spam controls, inbox settings, provider issues, fraud review, or factors outside our reasonable control.

9. Fraud and Compliance

We may:

• Require identity verification.
• Suspend, review, or cancel transactions suspected of fraud or abuse.
• Refuse access to features, rewards, or promotional programs where misuse is detected.

We are not liable for losses arising from fraudulent access to your account unless caused by our negligence.

10. Payments

Payments are processed by third-party payment providers.

We are not responsible for payment provider outages, processing delays, or errors outside our control.

11. Limitation of Liability

To the fullest extent permitted by law:

• Our liability is limited to the amount you paid for the relevant purchase.
• We exclude liability for indirect, incidental, or consequential loss.
• We are not responsible for retailer insolvency or changes to retailer policies.
• We are not liable for loss caused by events beyond our reasonable control.

Nothing excludes liability for death, personal injury, fraud, or any liability that cannot be excluded under applicable law.

12. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of purchase or relevant use applies to that purchase or use.

13. Governing Law

These Terms are governed by the laws of England and Wales, except where mandatory local consumer protection laws apply.
