Pocketloop Terms and Conditions

These Terms and Conditions govern your use of the Pocketloop website and services. By purchasing through Pocketloop, you agree to be bound by these Terms.

References to "Pocketloop", "we", "us" or "our" mean Pocketloop Ltd.

These Terms are governed by the laws of England and Wales.

2. Eligibility

You must:

  • Be at least 18 years old.
  • Have legal capacity to enter into a binding contract.
  • Use the service for lawful purposes only.

We may refuse service or suspend accounts where fraud, misuse, or unlawful activity is suspected.

3. What You Are Purchasing

When you purchase through Pocketloop:

  • You are purchasing the right to send a specified third-party gift through Pocketloop.
  • Depending on the product configuration, the recipient may be able to keep the selected brand or choose another available brand before making their final choice.
  • The underlying retailer gift card or code is only issued once the recipient makes their final choice and reveals the code through the Platform.
  • Until that point, no underlying retailer gift card is issued.

The validity period and any available Pocketloop features are displayed on the relevant product page at the time of purchase.

Once the retailer gift card is issued, it is subject to the retailer's own terms and conditions.

Pocketloop is not affiliated with, endorsed by, or sponsored by any listed retailer unless explicitly stated.

4. Redemption Period, Final Choice and Expiry

The redemption period applicable to your purchase is displayed on the relevant product page at the time of purchase.

The recipient must make their final choice and reveal the gift card code before the end of the stated redemption period. If no final choice is made before expiry, the right to receive the underlying gift card will expire, except to the extent any additional Pocketloop protection is expressly stated on the relevant product page at the time of purchase.

For Pocketloop protections, the recipient's final choice is made when they reveal the gift card code through the Platform.

After a final choice is made, the gift is treated as used in Pocketloop and is no longer eligible for Pocketloop swap rights or any unexercised pre-issuance protections.

Once the retailer gift card is issued, the retailer's standard terms and conditions apply. Pocketloop is not responsible for retailer policies, expiry changes, or usage restrictions.

Retailers may amend their terms from time to time. The applicable retailer terms are those in effect at the time the gift card is issued.

5. Pocketloop Features and Additional Protections

Some purchases may include optional Pocketloop features, such as sender-enabled brand swaps before the recipient makes their final choice, or other protections expressly described on the relevant product page at the time of purchase.

These features apply only before the recipient makes their final choice and reveals the gift card code.

Where a product page expressly offers any additional post-expiry option, reclaim right, refund mechanism or payout, that option will be governed by the terms presented on the relevant page at the time of purchase.

Any such option may be subject to:

  • Successful identity verification where required;
  • Fraud, compliance and security checks; and
  • Verification that the gift has not already been issued, redeemed or used.

Pocketloop reserves the right to refuse, suspend or cancel any feature use or additional protection where fraud, abuse or misuse is suspected.

6. No Cancellation After Purchase

By completing a purchase, you:

  • Request immediate performance of the digital service.
  • Acknowledge that you lose your statutory right to cancel once performance begins.

All purchases are final, except to the extent a specific Pocketloop protection is expressly stated on the relevant product page at the time of purchase.

7. Fraud and Compliance

We may:

  • Require identity verification.
  • Suspend or cancel transactions suspected of fraud.
  • Refuse feature use or additional protections where misuse or abuse is detected.

We are not liable for losses arising from fraudulent access to your account unless caused by our negligence.

8. Payments

Payments are processed by third-party payment providers.

We are not responsible for payment provider outages, processing delays, or errors outside our control.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the amount you paid for the relevant purchase.
  • We exclude liability for indirect, incidental, or consequential loss.
  • We are not responsible for retailer insolvency or changes to retailer policies.
  • We are not liable for loss caused by events beyond our reasonable control.

Nothing excludes liability for death, personal injury, or fraud where prohibited by law.

10. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to technical failures, regulatory changes, or third-party service interruptions.

11. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of purchase applies to that purchase.

12. Governing Law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction, except where mandatory local consumer protection laws apply.
